What is a NIE and is it really that important?
NIE (Número de Identificación de Extranjero) is a Foreigner Identification Number. Without it, it is impossible to conduct any major transaction in Spain, including buying real estate, opening a bank account, or setting up utility services. Obtaining it is the very first and mandatory step.
How much do I risk losing if I change my mind about buying after signing a Contrato de Arras?
When signing the most common type of deposit agreement (arras penitenciales), if the buyer backs out of the transaction, they lose the entire deposit amount (usually 10% of the property value). If the seller backs out of the transaction, they are obliged to return the deposit in double. We always verify the type of Arras contract so that you clearly understand your risks.
What are the main taxes I will pay when buying real estate?
When buying resale real estate, you pay the Property Transfer Tax (ITP), the rate of which varies from 6% to 10% depending on the region. When buying a newly built property from a developer, you pay VAT (IVA) at a rate of 10%.
Who pays for notary services and the registration of the transaction?
By law, the seller pays the majority of the notary fees, but in practice, the parties often agree that the buyer bears all closing costs (notary, Property Register). It is important to clearly stipulate this clause in the contract.
What is "plusvalía municipal" and who pays it?
This is a municipal tax on the increase in the value of urban land, which is triggered at the time of sale. By law, it is always paid by the seller. We ensure that this expense is not wrongfully passed on to the buyer.
Is it mandatory to hire a lawyer to assist with the transaction?
Formally, no, but it is highly recommended. A notary in Spain only certifies the legality of the transaction itself; they do not check the property for hidden debts, negotiate, or protect your interests. A lawyer conducts comprehensive Due Diligence and guarantees that you are purchasing a legally clean property without any "surprises."
