Why should I hire a lawyer if the notary is going to review the transaction anyway?
In Spain, a notary acts as an independent guarantor of the legality of the transaction itself at the time it is signed. However, the notary is not required to check for zoning violations, negotiate with the seller, draft a deposit agreement (Arras) that is favorable to you, or verify any outstanding utility bills. Protecting your financial interests prior to the transaction is the responsibility of your personal attorney.
Can I buy real estate in Spain without a residence permit?
Yes, foreign nationals can freely purchase real estate in Spain without a residence permit. To complete the transaction, you’ll only need a valid passport, a Foreigner Identification Number (NIE), and a Spanish bank account. We can help you obtain all these documents.
What taxes do you have to pay when buying a home in Catalonia?
When purchasing a new-construction property, you pay 10% VAT (IVA). When purchasing a resale property, you pay the property transfer tax (ITP). In Catalonia, the standard ITP rate is 10% (or 11% for properties costing more than 1 million euros). This is a government-backed guarantee program that helps cover up to 20% of a mortgage down payment. It is available to young people under 35 and families with minor children who are buying their first home in Spain and meet certain income criteria.
What is a Contrato de Arras, and why is it risky?
This is a deposit agreement signed prior to the main transaction. Typically, the buyer pays 10% of the property’s value. If you (the buyer) back out of the deal, you will lose this money. If the seller backs out, they are required to return double the amount of the deposit to you. We carefully review this agreement to ensure it includes protective clauses (such as a refund if the bank denies the mortgage).
Does buying real estate entitle you to a residence permit?
Yes. If you invest at least 500,000 euros in Spanish real estate (using your own funds, excluding a mortgage), you and your family are eligible for a “Golden Visa” (Investor Residence Permit). This status grants you the right to live and work in Spain. If the purchase amount is lower, you can apply for a residence permit without the right to work (No Lucrativa) by demonstrating sufficient passive income.
