Frequently asked questions about immigration and legal assistance in Spain

Do I have to pay for my studies before I receive my residence permit?

No, and that’s a key advantage. To submit your application, all you need is a “commitment to enroll” (compromiso de matriculación) from the educational institution. You’ll need to pay for the course and begin your studies within 3 months of receiving a positive decision.

Can I work while I'm in school?

Yes, but with some restrictions. You can work up to 30 hours a week, provided that the job does not interfere with your studies and is related to your field of study. However, the primary purpose of this residence permit is your studies, and you will only gain full work authorization after your permit is modified.

What happens if I don't finish the program?

If you fail to complete your studies through your own fault, you will not be able to convert your residence permit to a work permit and will lose your residency after 12 months.

What should the salary in the contract be for a successful modification?

The salary specified in the employment contract that you submit for modification must be at least equal to the minimum interprofessional wage (SMI), which in 2026 is €1,323 per month (gross) for a full-time position.

How much time do I have to look for a job after I graduate?

You can apply for a modification both during your 12-month residency and within 90 days after it ends. We recommend that you start looking for a job 2–3 months before your courses end.

Can I choose any course I like?

No, the course must lead to an official qualification and be registered with the State Employment Service (SEPE). These can be Certificado de Profesionalidad or Formación Profesional (FP) courses. We can help you verify whether the course you’ve chosen meets the legal requirements.
