Do you have to live in Spain to get a divorce there?
To file for divorce in Spain, it is sufficient for one of the spouses to be a resident of Spain, or for Spain to have been the couple’s last place of joint residence.
What is a "convenio regulador" and is it mandatory to draft one?
This is a key document in a divorce by mutual consent (uncontested divorce). In it, the spouses record all agreements: who will remain living in the family home, how child custody is distributed, the amount of child support/alimony, and the procedure for the division of property. Without this agreement, a divorce by mutual consent is impossible.
What is joint custody (custodia compartida)?
This is an arrangement in which both parents participate equally or almost equally in the upbringing and care of the child after a divorce. The child lives alternately with each parent. Spanish courts increasingly prefer this option.
How is child support (pensión de alimentos) calculated?
There is no fixed formula. The court takes into account the income and needs of both parents, as well as the needs and expenses of the child (education, healthcare, housing). The goal is to maintain a standard of living for the child that is as close as possible to what it was prior to the divorce.
Is a marriage concluded in Russia/Ukraine/Belarus recognized in Spain?
Yes, it is recognized. To initiate divorce proceedings in Spain, it is necessary to legalize and translate the marriage certificate and the children's birth certificates.
What is a "pareja de hecho" and what rights does it grant?
This is a registered civil partnership, which is largely equated to marriage, especially concerning inheritance rights and social guarantees in certain regions of Spain. However, upon separation, the procedure for the division of property differs from the dissolution of a marriage.
